PRIZE DRAWINGS
Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be an individual 18 years or older at time of entry purchase. Only one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Entries may be purchased via the Internet, or via the Benefactor Acceptance Form. All email communications, including the email ticket purchase confirmation, will be sent to the email address supplied during the purchase. It is the purchaser’s responsibility to provide a valid, deliverable email and mailing address to Environmental Systems Design, Inc. (ESD). ESD and its agents, committee members, vendors, volunteers and associates assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. By entering the raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the official raffle rules and regulations.
PRIZE DRAWINGS
A maximum of 500 tickets will be sold for the 2017 charity raffle. Key eligibility and prize drawing dates are as follows:
- All entries must be received by 12 p.m. (CST) on May 17, 2017, to be eligible for these drawings. Winning certificate numbers for the prizes will be drawn on May 17, 2017.
- Prizes will be drawn progressing in alphabetical order. ESD reserves the right not to accept entries at their discretion and to add additional prizes or drawings at any time.
PRIZES
The chance of a valid single ticket entry winning a prize shall be no less than 1-in-50 based on the total number of valid entries received for the raffle. In the event of a winning entry having more than one name, ESD will award the prize to the first name listed on the entry. Records of ESD shall be deemed correct if there is any discrepancy. ESD is not responsible for resolving any disputes that may arise from different individuals listed on a valid raffle certificate. With proper transfer documents bearing notarized signatures, as required by the raffle, a prize may be transferred. Prizes are not redeemable for cash.
NOTIFICATION OF WINNERS
All winners will be notified in writing or by phone of the prize won and any requisite procedure to claim the prize. Winners of all prizes shall have forty-five (45) calendar days from notification of winning, to inform ESD of their choice to take the prize. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw of any raffle drawing, the prize or its cash equivalent will be deemed to have been donated to ESD for use by the foundation. All winners, by entering, authorize ESD to publish their name and likeness on the website and for it to be used in other promotional materials by ESD.
TAXES AND IRS RULES
Purchase of raffle tickets are not tax-deductible.
WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers, by participating (and winners, by accepting a prize) release ESD and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of ESD shall be limited to ticket price paid and in the case of any dispute, ESD’s decision shall be final. ESD reserves the right to modify or amend the Official Raffle Rules without notice at any time.
